Affiliate Terms

These Affiliate Terms and Conditions (“Agreement”) govern your participation in the Affiliate Program (“Program”) offered by Web Design Society (“Company,” “we,” “us,” or “our”). By signing up or participating in the Program, you agree to be bound by the terms of this Agreement.

1. Enrollment in the Program

To enroll in the Program, you must submit a completed affiliate application through our website. We reserve the right to accept or reject any application at our sole discretion.

2. Affiliate Responsibilities

As an affiliate, you agree to:

Promote Web Design Society in a lawful and ethical manner.
Use only approved promotional materials provided by us or seek written permission for custom content.
Avoid any misleading or deceptive practices when promoting our services.
Ensure that your website or promotional channels do not contain any illegal, offensive, or inappropriate content.

3. Affiliate Links and Tracking

You will receive a unique affiliate link to track referrals. You must use this link for tracking purposes to ensure you are credited for eligible sales. We are not responsible for any missed commissions due to incorrect use of affiliate links.

4. Commissions and Payments

You will earn a commission for each qualifying sale referred through your affiliate link, based on the rate published on our affiliate dashboard or communicated in writing.
Commissions are paid out monthly after a 60-day holding period to allow for refunds and chargebacks.
Payments are made via PayPal, and you are responsible for ensuring your payment details are accurate and up-to-date.

5. Prohibited Activities

You may not:

Bid on our brand name or misspellings in paid advertising (e.g., Google Ads).
Send unsolicited email (spam) containing affiliate links.
Use your own affiliate link to purchase Web Design Society products for yourself (“self-referrals”).
Misrepresent our offerings or act as if you represent Web Design Society.

6. Term and Termination

This Agreement begins when you are accepted into the Program and will continue until terminated by either party.
We may terminate your participation at any time, with or without cause, by providing written notice.
Upon termination, you must immediately cease using all affiliate links and promotional materials.

7. Limitation of Liability

Web Design Society shall not be liable for any indirect, special, or consequential damages arising in connection with this Program. Our total liability shall not exceed the total commissions paid or payable to you under this Agreement.

8. Independent Contractor Relationship

Nothing in this Agreement creates a partnership, joint venture, agency, or employment relationship. You are acting as an independent contractor.

9. Modifications

We may update these terms at any time. You will be notified of significant changes by email or through the affiliate dashboard. Continued participation in the Program after any changes shall constitute your consent to the revised terms.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware, United States.
